20 Pickleball Courts are planned. 10 courts will be for the private use of residents of the Pelican Bay community. 10 courts will be for use by public players who are not Pelican Bay Foundation members.

Our amendment to guarantee that 50% of the pickleball courts will be for public use was approved by the Pelican Bay Foundation and the Collier County Board of County Commissioners on 2/13/24. The Amendment reads:
"Members of the public shall have access to 50% of the pickleball courts during the same days and hours as members of the Foundation. No more than 50% of the pickleball courts shall be for usage by members of the Foundation."
We believe that the schedule for the 10 public courts must meet the needs of public players. The public players have told us that they want Open Play all day, this is the goal. A few public players have asked for afternoon rentals, we plan to include limited rentals on the public courts. We are in contact with the County and the PBF to ensure that the schedule meets the needs of the public players. No. Pelican Bay residents will have 10 courts for their private use. They may not also buy a public membership to gain access to the public courts. The 10 public courts are for public players who are not Pelican Bay Foundation members. This is defined in the Amendment to the Management Agreement. The Amendment was approved on 2/13/24 by the Pelican Bay Foundation and the Collier County Board of County Commissioners .
The Amendment reads:
"Members of the public shall have access to 50% of the pickleball courts during the same days and hours as members of the Foundation. No more than 50% of the pickleball courts shall be for usage by members of the Foundation."
The short answer is: The Amendment prohibits Foundation members from using more than 50% of the 20 pickleball courts.
To understand why Foundation members cannot use the public courts, it is important to carefully read the second sentence in the Amendment to the Management Agreement, which says: "No more than 50% of the pickleball courts shall be for usage by members of the Foundation."
The Amendment to the Management Agreement was reviewed by the Collier County Attorney and the Pelican Bay Foundation Attorney. The Amendment was approved by the PBF & the BOCC at the Board of County Commissioners meeting on 2/13/24.
The full text of the Amendment says:
"Members of the public shall have access to 50% of the pickleball courts during the same days and hours as members of the Foundation. No more than 50% of the pickleball courts shall be for usage by members of the Foundation."
The second sentence of the Amendment says that NO MORE than 50% of the courts can be used by Foundation members. So, if all 10 Foundation courts are in use, then Foundation members are already using the maximum of 50% of the 20 pickleball courts. The Amendment prohibits Foundation members from using more than 50% of the courts.
